Finch Wireless.AI – Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of Finch Wireless.AI services, including voice, text, data, SIM/eSIM, devices, applications, and network access. By activating or using Finch Wireless.AI services, you agree to comply with this AUP in addition to our Terms & Conditions and Privacy Policy.

1. Purpose of This Policy

Finch Wireless.AI provides wireless services intended for personal, lawful, and reasonable use. This policy exists to:

  • Protect network integrity
  • Ensure fair access for all customers
  • Prevent fraud, abuse, and illegal activity
  • Comply with carrier and regulatory requirements

2. Permitted Use

You may use Finch Wireless.AI services to:

  • Make and receive voice calls
  • Send and receive text messages
  • Use mobile data for normal personal activities such as:
    • Browsing
    • Email
    • Social media
    • Streaming (within plan limits)
    • Hotspot use (if included in your plan)

3. Prohibited Activities

The following activities are strictly prohibited:

A. Illegal or Harmful Use

  • Any activity that violates local, state, federal, or international law
  • Harassment, threats, or abusive communications
  • Distribution of unlawful, harmful, or explicit content

B. Network Abuse

  • Excessive or unreasonable usage that degrades network performance
  • Continuous automated or machine-generated activity
  • SIM farming or use of multiple SIMs to bypass limits
  • Circumventing speed, data, or usage restrictions

C. Messaging & Calling Abuse

  • Robocalling or automated dialing
  • Bulk or spam messaging
  • SMS pumping or toll fraud
  • Artificial call traffic generation

D. Commercial & Resale Use

  • Reselling Finch services without authorization
  • Using service as a gateway, server, or relay
  • Providing public Wi-Fi or data redistribution
  • Business or enterprise use without written approval

E. Device & SIM Misuse

  • Using unauthorized or modified devices
  • SIM cloning or tampering
  • Using Finch SIMs in prohibited equipment
  • Bypassing device compatibility requirements

4. Unlimited & High-Speed Data Use

“Unlimited” plans are subject to fair use:

  • High-speed data is provided up to your plan’s data allowance
  • Speeds may be reduced after reaching the high-speed threshold
  • Usage inconsistent with normal consumer behavior may trigger review

Finch Wireless.AI reserves the right to manage network traffic to maintain service quality.

5. Enforcement & Consequences

If you violate this AUP, Finch Wireless.AI may take one or more of the following actions without notice or refund:

  • Temporary speed reduction
  • Service suspension
  • Termination of service
  • Blocking of specific features
  • Referral to law enforcement (if required)

6. No Refunds for Violations

Accounts suspended or terminated due to AUP violations are not eligible for refunds, credits, or reinstatement.

7. Monitoring & Investigation

Finch Wireless.AI may monitor usage patterns and investigate activity to:

  • Ensure compliance
  • Protect customers and the network
  • Meet legal and carrier obligations

We do not monitor call or text content except as required by law.

8. Reporting Abuse

If you believe your service has been misused or compromised, contact us immediately.

9. Changes to This Policy

Finch Wireless.AI may update this Acceptable Use Policy at any time. Continued use of services constitutes acceptance of any updates.
